By accessing or using ProperPost ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

ProperPost LLC ("we," "us," or "our") reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

ProperPost provides a comprehensive privacy and communication preference management platform that:

• Enables users to submit opt-out requests for marketing communications
• Manages communication preferences across multiple channels
• Facilitates GDPR, CCPA/CPRA, and TCPA compliance for organizations
• Processes data subject access requests (DSARs)
• Provides privacy rights management tools

You agree to:

• Provide accurate, current, and complete information when submitting requests
• Maintain the confidentiality of any reference numbers or tracking IDs provided
• Use the Service only for lawful purposes and in compliance with all applicable laws
• Not attempt to interfere with, compromise, or disrupt the Service or its security
• Not use automated systems (bots, scripts) to access the Service without permission

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy.

Key commitments:

• Data Minimization: We collect only the information necessary to process your request
• Encryption: All sensitive data is encrypted using AES-256-GCM
• Compliance: We comply with TCPA, TSR, CAN-SPAM, GDPR, CCPA/CPRA, and 20+ state privacy laws
• Retention: Data is retained only as long as legally required and deleted according to our retention schedule

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of ProperPost LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content without our express written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERPOST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising out of or relating to the Service shall not exceed the greater of $100 or the amount you have paid us in the past 12 months.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

You agree to indemnify, defend, and hold harmless ProperPost LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy or intellectual property rights

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Sheridan, Wyoming.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
